Members of the Illinois House and Senate Republican caucuses have urged Governor Pritzker to veto Senate Bill 328. The bill is seen as potentially benefiting trial lawyers at the expense of economic growth. A lawsuit has been filed in Sangamon County court to enforce the Illinois Constitution’s Three Readings Rule, which Republicans argue was bypassed when the bill was pushed through after midnight on the last day of session.
The legislation proposes changes to Illinois’ judicial system, allowing out-of-state businesses to be sued in Illinois courts for incidents unrelated to the state. It also includes provisions for suing foreign businesses registered in Illinois. The passage of this bill has raised concerns about transparency and adherence to constitutional procedures.
“We are answering the call of job creators, good government watchdog groups, and most importantly, our constituents, to stand up for transparency and against this job-killing legislation,” stated House Minority Leader Tony McCombie (R-Savanna). He added that Governor Pritzker should veto SB 328 to demonstrate support for economic development over legal pursuits.
Despite Democratic majorities in both chambers, significant legislative actions continue without following constitutionally mandated procedures such as public hearings. The controversial bill encourages lawsuits against any licensed business in Illinois regardless of its connection to the state.
