McLean County Zoning Board of Appeals met June 7.

Here are the minutes provided by the board:

1. CALL TO ORDER: Chair, James Finnigan called the meeting to order at 7:00 PM.

2. ROLL CALL: Secretary Philip Dick called the roll and noted the presence of a quorum as follows: James Finnigan, Ruth Novosad, Brian Bangert, Michael Kuritz and Julia Turner. Members Rick Dean and Mary Beth Taylor were absent. Also present were Darrell Mitchell, Zoning Enforcement Officer, Chris Spanos, Chief Civil Assistant State’s Attorney and Taylor Williams, Assistant State’s Attorney.

3. APPROVAL OF MINUTES: Motion was made by Kuritz/Bangert to approve the minutes from the May 3, 2022, Zoning Board of Appeals meeting.

The minutes were approved by voice vote.

4. APPEARANCE BY MEMBERS OF THE PUBLIC: No one came forward to speak on matters not on the agenda.

5. REGULAR AGENDA:

Case ZA-22-05, an application of Happy Zeus, LLC., in case ZA-22-05 on parcel 13-36-376- 001. It is requesting a map amendment to change the zoning classification from A-Agriculture District to M-1 Restricted Manufacturing District on property in Dry Grove Township at 2407 W. Market St., Bloomington, IL.

Secretary Dick called the case, provided exhibits to the board, and submitted a staff report for review. He indicated that staff recommends approval of the proposed text amendment.

No one appeared to represent the applicant in the case. Secretary Dick indicated that he recommended that he could answer questions about the case. Mr. Dick indicated that the applicant is the owner of Hermes Service and Sales and that the owner Stuart Nerby plans to move his business, currently located in the City of Bloomington, to this location. He said that the use would be a contractor’s office and shop.

The board reviewed and discussed the proposed map amendment.

Motion was made by Turner/Kuritz to recommend approval of case ZA-22-05.

The roll call vote was five members for the motion to recommend approval, none opposed, and Members Rick Dean and Mary Beth Taylor were absent.

Case SU-22-02, an application of Breezewood Solar, LLC by Cypress Creek Renewables, in case SU-22-02 on parcel 21-21-176-002. It is requesting to amend and renew special use case SU-20-06 for a Solar Power Generating Facility in the Agriculture District on property located in Bloomington Township immediately southwest of the intersection of Margaret St. and the Business U.S. Highway 51 Frontage Rd.

Secretary Dick called the case, provided exhibits to the board, and submitted a staff report for review. He indicated that staff recommends approval of the proposed special use with stipulations.

Ryan McQuigg, 732 S. Financial Place, Chicago, IL, appeared to give testimony and was sworn. Mr. McQuigg presented a paper copy and then made a PowerPoint presentation to the Board. Mr. McQuigg indicated that the property would be secured by a fence seven feet in height and that there would be cameras that covered the property for security. He indicated that the solar panels would be cleaned if they were dirty or did not generate electricity properly.

The board reviewed and discussed the proposed special use application. It was proposed that stipulation #6 should be amended to add the word maintain to the stipulation to read as follows: “The applicant shall plant and maintain two rows of evergreen trees near the north property line between the residential subdivision and the solar arrays”.

Motion was made by Kuritz/Turner to recommend approval of case SU-22-02 with the staff recommended stipulations and the amendment to stipulation #6.

The roll call vote was five members for the motion to recommend approval, none opposed, and Members Rick Dean and Mary Beth Taylor were absent.

Case ZA-22-06, an application of the City of Bloomington, in case ZA-22-06 on parcels 07-01- 251-005 & 07-01-401-002. It is requesting a map amendment to change the zoning classification from the R-1 Single Family Residence District to the A-Agriculture District on property in Hudson Township immediately southeast of the intersection of County Highway 8 and Waterside Way. This includes 25539 Waterside Way, Hudson, IL & 25432 Davis Lodge Rd., Hudson, IL.

Secretary Dick called the case, provided exhibits to the board, and submitted a staff report for review. He indicated that staff recommends approval of the proposed map amendment.

Joe Darter, 25515 Waterside Way, Hudson, IL and Brent Lueschen, 603 W. Division St., Bloomington, IL, appeared to give testimony and were sworn.

Mr. Darter and Mr. Lueschen indicated that they work for the City of Bloomington and were available to answer questions. Mr. Darter indicated that he agrees with the staff report and has nothing further to add.

The board reviewed and discussed the proposed map amendment.

Motion was made by Turner/Bangert to recommend approval of case ZA-22-05.

The roll call vote was five members for the motion to recommend approval, none opposed, and Members Rick Dean and Mary Beth Taylor were absent.

6. ADJOURNMENT: The Chair declared the meeting adjourned at 8:00 PM.
