REPORT FROM THE MAYOR:

Mayor Zalucha discussed zoning matters that are on the agenda for tonight.

Reported there will be an executive session tonight.

REPORT FROM CLERK - STACY SHOEMAKER:

Clerk Shoemaker reported that everyone should have the ZBA sheets for tonight.

REPORT FROM OFFICE MANAGER-STACY SHOEMAKER:

No report.

REPORT FROM CHIEF GERIETS:

Chief Geriets reported that he will have the police reports at the next meeting.

Reported the two police officers we hired are on their own now. We do have a vacancy for a full time yet.

REPORT FROM CODE COMPLIANCE-DAVE SHAFER:

David Shafer reported working on several building permit applications. One of the permits requires a variance which is up for approval tonight.

Reported the Pavlov Media Fiber Hut location is still being worked out.

Reported having a zoning hearing scheduled August 22 for a few items.

REPORT FROM PUBLIC WORKS -DAVID SHAFER:

Water:

David Shafer the staff has begun working on the Water Main replacement on Karr Street. Currently we are just past Sunset Ave, working North toward Randolph.

Reported hydrant flushing is complete, we are working on securing materials for repairs and repainting as needed. Sewer:

Reported the dosing tank pumps have been delivered along with most of the materials needed for installation. We will be installing the pumps in the next week.

Parks:

Reported Fry & Harris have nearly completed the rail removal that was part of the Caboose moved a couple of years ago. This will allow us to develop a walking path along the old RR ROW and the future extension of North Street to Buchanan.

Reported we have closed the handicapped stall at the concession stand bathrooms due to a leak and mold. Compost Facility:

Reported taking some materials to the landfill after failing tests again.

Equipment & Staff:

Reported having items to be discussed in executive session.

Reported working on proposal review for the 2520 replacement.

Reported we will be adding Malicious Domain Blocking and Reporting to our DNS routing to help prevent potential problems.

REPORT FROM ENGINEER-DAVID SHAFER:

David Shafer reported the Prairie View Final Plat is being presented for approval tonight. Reported the Final Plat for 101 E Cleveland is expected at the next meeting.

Reported on the 2020 water main replacement. The project is out for bid and bids are due by August 23rd. Reported on the 2022 Karr Street Project and we are working on splitting the project and rebidding both parts separately.

REPORT FROM TREASURER SUE GILPIN:

Absent. Left financials.

REPORT FROM BUDGET OFFICER-GEOFF DODDS:

Geoff Dodds reported there will be a 1st quarter report at the next meeting that will address the fiscal year so far. Discussion on the residential at Groots and when it is coming.

REPORT FROM ADMINISTRATOR-GEOFF DODDS:

Geoff Dodds reported on COVID-19 and the CDC amendments to the guidelines.

Reported having the final plat for approval for the Prairie View at Heyworth Subdivision. There are conditions attached to the approval.

Reported we continue to have conversations with the developers of the Groots Subdivision about future improvements.

Reported Heyworth Liquors has completed its improvements, but we have not received a request for reimbursement yet.

Reported we have received a professional services agreement from Jacob & Klein to again amend our TIF VI and the amount was $15,000.

Reported Pavlov continues installation, and we estimate around 20% of the installation is now completed in town. Reported on Cyber Security with our liability insurance. We will incur some costs to get this process complete. Geoff Dodds reviewed the action items on the agenda for tonight.

Reported on the items that will be on the next regularly scheduled board meeting agenda.

2022-34 (Lauterberg, Strunk) Ordinance approving a final plat for the “Prairie View at Heyworth” Subdivision in the Village of Heyworth. 4-yes. 1-no (Brown). [Motion Carried]

2022-38 (Sheppard, Lauterberg) Resolution authorizing to proceed with the Illinois Transportation Enhancement Program Grant to assist with Village of Heyworth eligible improvements. 5-yes.0-no. [Motion Carried]

2022-39 (Sheppard, Strunk) Resolution approving a special event permit for the Hope/Heyworth Elementary School for use of public property of the Village of Heyworth on September 23, 2022. 5-yes.0-no. [Motion Carried]

2022-40 (Flubacker, Sheppard) Resolution approving a special event permit for the Heyworth High School for use of public property of the Village of Heyworth on September 21, 2022. 5-yes.0-no. [Motion Carried] Discussion on the ZBA items.

Findings and Fact:

1. The suitability of the subject property for uses authorized by the existing zoning. Trustee Sheppard agrees with the zoning board of appeals. 5-yes. 0-no.

2. The length of time the property has remained vacant as zoned considered n the context of land development in the area. Trustee Sheppard agrees with the zoning board of appeals. 5-yes. 0-no.

3. The suitability of the subject property for uses authorized by the proposed zoning. Trustee Sheppard agrees with the rezoning for the school traffic. 5-yes. 0-no.

4. Compatibility with the existing land uses of nearby property. Trustee Sheppard the parking lot would make a huge difference for all the events at the school. 5-yes. 0-no.

5. Compatibility with existing zoning districts nearby property. Trustee Lauterberg agrees with zoning board of appeals.

6. The trend of development, if any, in the general area of the property in question, including changes, if any, which have taken place since the day the property in question was placed in its present zoning. Trustee Lauterberg thinks it is met. 5-yes. 0-no.

7. Relative gain or hardship to the public as contrasted and compared to the hardship or gain of the individual property owner resulting from the approval or denial of the proposed zoning map amendment. Trustee Lauterberg-it will be a gain for the public. 5-yes. 0-no.

2022-35 (Lauterberg, Sheppard) Ordinance approving a zoning map amendment from R1-Single Family Residence to PU-Public Use for 522 E. Main St., parcel number 28-34-376-020, in the Village of Heyworth. 5-yes.0-no. [Motion Carried]

Findings and Fact:

1. The particular physical surroundings, shape, or topographical conditions of the specific property involved is causing or will cause a particular hardship upon the owner of distinguished from a mere inconvenience or better use if the strict letter of the regulation were to be carried out. Trustee Lauterberg-if this lot is too small to build a house this would be the next step. 5-yes. 0-no.

2. The conditions and hardships upon which the application for variation is based are significantly greater than other applicable properties within the same zoning classification. Trustee Sheppard-because you can’t build R-1 on this anyway. 5-yes. 0-no.

3. The purpose of the variation is not based exclusively upon a desire to receive financial gain on the property. Trustee Lauterberg-no financial gain by building a garage. 5-yes. 0-no.

4. The alleged difficulty or hardship has not been created by any person presently having an interest in the property. Trustee Lauterberg-property was purchased as is. 5-yes. 0-no.

5. The proposed variation will not impair an adequate supply of light and air to adjacent property, substantially increase the danger of fire, or otherwise endanger the public safety, or substantially diminish or impair property values within the neighborhood. Trustee Lauterberg-the garage will not change the air flow. 5-yes. 0-no.
