City of Pontiac City Council met Dec. 5.

Here are the minutes provided by the council:

The regular meeting of the Pontiac City Council was held on December 5, 2022. Mayor Alvey called to order the meeting of the City Council at 7:00 P.M.

The City Clerk was directed to call roll, and the following members of the Council were present: Barr, Giovanini, Kallas, Lee, Hicks, Bradshaw, Clark, Gabor and Wille.

Absent: Eckhoff

MEETING OF THE PONTIAC CIVIC CENTER AUTHORITY

Mayor Alvey asked that the record show the same Aldermen present for this meeting as are present for the regular Council meeting: Barr, Giovanini, Kallas, Lee, Hicks, Bradshaw, Clark, Gabor and Wille.

Mayor Alvey asked if there was any business to come before the Civic Center Board this evening. Hearing none, he declared the meeting closed.

Mayor Alvey asked for a moment of silence in remembrance of Oscar Gorbet. Chris Brock told highlights and stories of Oscar's career with the City.

CONSENT AGENDA

Mayor Alvey stated that there were three items on the consent agenda. He asked if there were any items that needed to be removed for later discussion. Hearing none, motion made by Bradshaw, second by Hicks that the items on the consent agenda be approved as presented.

A. Motion by Bradshaw, second by Hicks to approve the minutes of the November 21, 2022 as written. On a roll call vote, motion carried 9-0. Aye votes recorded: Barr, Giovanini, Kallas, Lee, Hicks, Bradshaw, Clark, Gabor and Wille.

B. Motion by Bradshaw, second by Hicks to approve the payment of bills totaling $422,514.31 from all funds. On a roll call vote, motion carried 9-0. Aye votes recorded: Barr, Giovanini, Kallas, Lee, Hicks, Bradshaw, Clark, Gabor and Wille.

C. Motion by Bradshaw, second by Hicks to approve a Transient Merchant License to Tree- Ripe Fruit Co. On a roll call vote, motion carried 9-0. Aye votes recorded: Barr, Giovanini, Kallas, Lee, Hicks, Bradshaw, Clark, Gabor and Wille.

REGULAR AGENDA

A & B. Appointment Library Board of Trustees

Motion by Hicks, second by Lee to approve the appointments to the Library Board of Trustees, John Wille to a term to expire June of 2024 and Larry Krominga to a term set to expire June of 2023. On a roll call vote, motion carried 9-0. Aye votes recorded: Barr, Giovanini, Kallas, Lee, Hicks, Bradshaw, Clark, Gabor and Wille.

C. Proposal Backyard Chickens

Motion by Giovanini, second by Bradshaw to have City attorney draft an Ordinance and revisit the possibility of chickens allowed in backyard in City limits. On a roll call vote, motion carried 6-3. Aye votes recorded: Giovanini, Kallas, Lee, Hicks, Bradshaw, and Clark.

Nay votes recorded: Barr, Gabor and Wille.

D. Ordinance 2022-0-028 - Special Use Permit for Cannabis Dispensary

Associates for Triumph 7 Investments LLC to do business as Snap Canna explained the plans for a cannabis dispensary at 1910 W. Reynolds St. including security, state rules and regulations, no on sight consumption and security guards.

Motion by Gabor, second by Clark to approve Ordinance 2022-0-028, an Ordinance approving a Special Use permit for a license to operate a cannabis dispensary at 1910 W. Reynolds St. By Triumph 7 Investments, LLC, d/b/a Snap Canna Adult Use Cannabis Dispensary, as written. On a roll call vote, motion carried 7-2. Aye votes recorded: Barr, Kallas, Lee, Hicks, Bradshaw, Clark, Gabor. Nay votes recorded: Giovanini and Wille.

E. Ordinance 2022-0-029 - Mutual Aid Agreement

Motion by Hicks, second by Barr to approve Ordinance 2022-0-029, authorizing an Intergovernmental Agreement for participation in the Mutual Aid Box System, as written. On al roll call vote, motion carried 9-0. Aye votes recorded: Barr, Giovanini, Kallas, Lee, Hicks, Bradshaw, Clark, Gabor and Wille.

F. Approval - ITEP Rail Trail and t 66 Bike Trail Phase I Engineering

Motion by Barr, second by Wille to approve the Engineering Agreement with the Farnsworth Group in the amount of $51,200.00 for Phase 1 Engineering on the ITEP Rail Trail and Rt 66 Bike Trail, using Grant Funds. On a roll call vote, motion carried 9-0. Aye votes recorded: Barr, Giovanini, Kallas, Lee, Hicks, Bradshaw, Clark, Gabor and Wille.

G. Ewing Drive Sanitary Sewer Extension Engineering Services

Motion by Gabor, second by Kallas to approve the Engineering Agreement with the Chamlin & Associates for the Ewing Drive Sanitary Sewer Extension. On a roll call vote, motion carried 9-0. Aye votes recorded: Barr, Giovanini, Kallas, Lee, Hicks, Bradshaw, Clark, Gabor and Wille.

H. Insurance Renewal

Motion by Bradshaw, second by Hicks to approve the City's insurance at a cost of $695,485.00. On a roll call vote, motion carried 9-0. Aye votes recorded: Barr, Giovanini, Kallas, Lee, Hicks, Bradshaw, Clark, Gabor and Wille.

1. Ordinance 2022-O-021 - Solar Farm Lease Option - Pearl St.

Motion by Giovanini, second by Lee to approve Ordinance 2022-0-021, an Ordinance approving a lease option agreement for a solar energy facility site with BAP Power Corp d/b/a Cenergy Power at the City property known as Pearl Street property, as written. On a roll call vote, motion carried 9-0. Aye votes recorded: Barr, Giovanini, Kallas, Lee, Hicks, Bradshaw, Clark, Gabor and Wille.

J. Westview Drive/Countryside Annexation

Motion by Kallas, second by Hicks to begin the process for annexation at Westview/Countryside Rd. On a roll call vote, motion carried 9-0. Aye votes recorded: Barr, Giovanini, Kallas, Lee, Hicks, Bradshaw, Clark, Gabor and Wille.

There will be a January public hearing for annexation, with the ordinance coming to the Council the 2nd meeting in January.

K. Employee Christmas Gifts

Motion by Gabor, second by Wille to approve the Christmas gifts for City employees at $75.00 for full time employees and $50.00 for part-time and paid on call. On a roll call vote, motion carried 9-0. Aye votes recorded: Barr, Giovanini, Kallas, Lee, Hicks, Bradshaw, Clark, Gabor and Wille.

L. Police Vehicle Purchase

Motion by Lee, second by Hicks to approve the purchase of a 2022 Ford Interceptor from Morrow Brothers Ford at a cost of $37,705.00. On a roll call vote, motion carried 9-0. Aye votes recorded: Barr, Giovanini, Kallas, Lee, Hicks, Bradshaw, Clark, Gabor and Wille.

The lights, siren and radio will be transferred from a current vehicle.

M. Wastewater Treatment Department Purchase - Towable Light Tower

Motion by Bradshaw, second by Kallas to approve the purchase of a Towable Light Tower form United Rental in East Peoria at a cost of $4,721.00. On a roll call vote, motion carried 9-0. Aye votes recorded: Barr, Giovanini, Kallas, Lee, Hicks, Bradshaw, Clark, Gabor and Wille.

N. Ordinance 2022-030 - Levy

Motion by Wille, second by Gabor to draft Ordinance 2022-0-030, the ordinance leving a tax for the 2022-2023 fiscal year. And bring to Council for approval. On a roll call vote, motion carried 9-0. Aye votes recorded: Barr, Giovanini, Kallas, Lee, Hicks, Bradshaw, Clark, Gabor and Wille.

Mayor Comments

Mentioned the Light Up Parade and that it was well attended. Thanked staff for all their work

Administrator Comments

Noted that there are ice rink installation problems and hope to be ready to use soon.

He also thanked staff for the work on the Light Up Parade.

Council Comments

Alderman Barr asked about using a mobile speed device on Indiana Ave. to correct the speeding problem. Plans are to include in next years budget.

Alderman Kallas asked if the Council Chambers could be arranged different.

Public Comments

Tim Lewis asked about the stop lights along Howard St/Rt 116. Staff explained that it is a State Rd, not a City, and the State was waiting for a part to reset lights.

Executive Session

Motion by Giovanini, second by Bradshaw to adjourn to Executive Session for the purpose of discussing and considering Personnel matters and Property Acquisition as authorized under Section 2(c)2 of the Illinois Open Meetings Act. On a roll call vote, motion carried 9-0. Aye votes recorded: Barr, Giovanini, Kallas, Lee, Hicks, Bradshaw, Clark, Gabor and Wille.
