City of Pontiac City Council met May 15.

Here are the minutes provided by the council:

The regular meeting of the Pontiac City Council was held on May 15, 2023. Mayor Alvey called to order the meeting of the City Council at 7:00 P.M.

The City Clerk was directed to call roll, and the following members of the Council were present: Barr, Giovanini, Eckhoff, Kallas, Causer, Lee, Bradshaw, Cranford, Howard and Wille.

CONSENT AGENDA

Mayor Alvey stated that there were three items on the consent agenda. He asked if there were any items that needed to be removed for later discussion. Hearing none, motion made by Eckhoff, second by Bradshaw that the items on the consent agenda be approved as presented.

A. Motion by Eckhoff, second by Bradshaw to approve the minutes of the May 1, 2023 City Council meeting. On a roll call vote, motion carried 10-0. Aye votes recorded: Barr, Giovanini, Kallas, Eckhoff, Causer, Lee, Bradshaw, Cranford, Howard and Wille.

B. Motion by Eckhoff, second by Bradshaw to approve payment of bills totaling $191,166.40 from all funds. On a roll call vote, motion carried 10-0. Aye votes recorded: Barr, Giovanini, Kallas, Eckhoff, Causer, Lee, Bradshaw, Cranford, Howard, and Wille.

C. Motion by Eckhoff, second by Bradshaw to approve Transient Merchant License to Tree-Ripe Fruit Co. On a roll call vote, motion carried 10-0. Aye votes recorded: Barr, Giovanini, Kallas, Eckhoff, Causer, Lee, Bradshaw, Cranford, Howard, and Wille.

REGULAR AGENDA

A. Committee Reports

Infrastructure Committee

Meeting held on May 11, 2023 and discussion on the Emergency Declaration End, including new guidelines for temporary outdoor dining, downtown parking and Madison St. being one lane.

Finance Committee

Discussion on the sale of "legal" fireworks by transient groups and permits needed to use products. An Ordinance will be brought before the Council. Also, a fee schedule for the Eagle Performing Arts Theater.

B. Fee Schedule - Eagle Performing Arts

Motion by Kallas, second by Howard to approve the fee schedule for the Eagle Performing Arts and Conference Center as written. On a roll call vote, motion carried 10-0. Aye votes recorded: Barr, Giovanini, Kallas, Eckhoff, Causer, Lee, Bradshaw, Cranford, Howard, and Wille.

C. Ordinance 2023-0-014 - Fireworks

Motion by Wille, second by Lee to approve Ordinance 2023-0-014, an Ordinance amending the regulating sales of fireworks, which is unlawful to sell or use any display fireworks pursuant to the Illinois Pyrotechnic Act, as written. On a roll call vote, motion carried 10-0. Aye votes recorded: Barr, Giovanini, Kallas, Eckhoff, Causer, Lee, Bradshaw, Cranford, Howard, and Wille.

D. Approval - Tuck pointing Old City Hall - Abraham Masonry

Motion by Eckhoff, second by Wille to approve the tuck pointing at Old City Hall by Abraham Masonry at a cost of $9,695.00 using TIF funds. On a roll call vote, motion carried 10-0. Aye votes recorded: Barr, Giovanini, Kallas, Eckhoff, Causer, Lee, Bradshaw, Cranford, Howard, and Wille.

E Bid Award - Vermillion Street Sidewalk Maintenance

Motion by Eckhoff, second by Bradshaw to approve the bid from HJ Eppel for sidewalks from Lincoln St. to South St. At a bid price of $111,577.50. On a roll call vote, motion carried 10-0. Aye votes recorded: Barr, Giovanini, Kallas, Eckhoff, Causer, Lee, Bradshaw, Cranford, Howard, and Wille.

F. Right-of-Way Utility Construction

Discussion on the permit agreement modifications for contractors for boring for Digital Broadband, including a surety bond instead of cash bond, exception for JULIE and permit fee.

Mayor Comments

The Mayor noted that May 26th is National Road Trip Day and we should have visitors in Pontiac and also thanked the volunteers for the Lori Bristow Beautification Day.

Administrator Comments

Jim Woolford announced that Jr. Baseball has started and coming weekend should be a busy gold weekend.

Council Comments

Alderman Giovanini asked again about the Stillwell Building. Barriers are to be put up soon, but City attorney, Alan Schrock, will contact Stillwell's attorney for any more information

Public

Steve Stacy, Jim Slown, Gary McDonald and many other neighbors in the area of Pearl St., voiced their opinion of being against the proposed Solar Farm. City Administrator, Jim Woolford said the proposed site has not come to the Council for vote and noted that the Planning & Zoning Committee voted to deny proposal.

Executive Session

Motion by Kallas, second by Wille to adjourn to Executive Session for the purpose of discussing Property Acquisition matters as authorized under Section 2(c)2 of the Illinois

Open Meetings Act. On a roll call vote, motion carried 10-0. Aye votes recorded: Barr, Giovanini, Kallas, Eckhoff, Lee, Hicks, Bradshaw, Clark, Gabor and Wille.

Adjournment

On motion duly made and seconded, the regular meeting of the City Council is adjourned.
