McLean County Zoning Board of Appeals met Aug. 5.

Here are the minutes provided by the board:

1. CALL TO ORDER: Chair, James Finnigan called the meeting to order at 7:00 PM.

2. ROLL CALL: Secretary Philip Dick called the roll and noted the presence of a quorum as follows: James Finnigan, Michael Kuritz, Rick Dean, Ruth Novosad, Brian Bangert, Shirley Deerwester, and alternate member Steve Kerber. Member Julia Turner was absent. Also present were Darrell Mitchell, Zoning Enforcement Officer, and Taylor Williams, Assistant State’s Attorney.

3. APPROVAL OF MINUTES: Motion was made by Kuritz/Bangert to approve minutes from the July 2, 2024, Zoning Board of Appeals meeting. The minutes were approved by voice vote.

4. APPEARANCE BY MEMBERS OF THE PUBLIC: No one came forward to speak on matters not on the agenda.

5. REGULAR AGENDA:

Case ZV-24-04, an application of Matthew Tague, representing Michael Holder, in case ZV 24-04 on parcel 07-12-126-010. He is requesting a variance in the paving requirement to allow graded asphalt millings for a commercial parking lot rather than asphalt, concrete, or asphaltic concrete as required in the C-Commercial District on property in Hudson Township immediately west of 1750 East Rd. and 340 feet south of 2500 North Rd.

Secretary Dick called the case, provided exhibits to the board, and submitted a staff report for review. He indicated that staff recommends that the proposed application meets all the standards set forth in Section 350-17.F. (1) (c) (Standards for Variances) of the McLean County Code, provided the asphalt millings are graded consistent with a storm water management plan.

Matthew Tague, 1713 Fairfield Dr., Normal, IL and Michael Holder, 25119 White Owl Ln., Hudson, IL appeared to give testimony and were sworn. Mr. Tague indicated that since the Green Gables Bar and Grill opened on May 19, 2024, there has been a shortage of off-street parking; customers are parking on the side of nearby streets. He said that the City of Bloomington has posted no parking signs on some of the streets as a response to the parking generated from the Green Gables Bar and Grill.

Mr. Holder indicated that the parking could be used for employees of the Green Gables Bar and Grill.

LeRoy Shouse, 25272 Hiawatha Ln., Hudson, IL appeared to give testimony and was sworn. Mr. Shouse indicated that he lives nearby and that he supports this case to provide more parking for the Green Gables Bar and Grill.

Mr. Tague indicated in closing that the Green Gables Bar and Grill is busier now than it has ever been. And that he would appreciate approval of the variance.

Motion was made by Kuritz/Deerwester to approve case ZV-24-04, provided the asphalt millings are graded consistent with a storm water management plan.

The roll call vote was seven members for the motion to approve, none opposed, and Member Turner was absent.

Case ZV-24-05, an application of Matthew Matigian in case ZV-24-05 on parcel 08-06-302- 010. He is requesting a variance in side yard requirements to allow a shed to be 6 feet from the property line rather than 20 feet as required in the R-1 Single Family Residence District on property in Money Creek Township at 25250 Hiawatha Ln., Hudson, IL.

Secretary Dick called the case, provided exhibits to the board, and submitted a staff report for review. He indicated that staff recommends that the proposed application meets all the standards set forth in Section 350-17.F. (1) (c) (Standards for Variances) of the McLean County Code.

Matthew Matigian, 25250 Hiawatha Ln., Hudson, IL appeared to give testimony and was sworn. Mr. Matigian indicated that his family needs the shed for the storage of stuff that they have collected over the years, and to be able to use their garage for parking vehicles instead of for storing this stuff.

Motion was made by Dean/Kuritz to approve case ZV-24-04.

The roll call vote was seven members for the motion to approve, none opposed, and Member Turner was absent.

Case SU-24-07, an application of J&A Grain, LLC, in case SU-24-07 on parcel 34-03-200-004. It is requesting a special use to expand an Agricultural Processing Facility that was approved in case SU-08-07 in the A-Agriculture District on property in Funks Grove Township at 9641 E 200 North Road, McLean, IL.

Secretary Dick called the case, provided exhibits to the board, and submitted a staff report for review. He indicated that staff recommends that the proposed application meets all the standards set forth in Article VIII Section 350-56 (Standards for Special Use Permits) of the County Code.

Dan Witte, 8049 N 1200 East Rd., Shirley, IL appeared to give testimony and was sworn. Mr. Witte indicated that he had nothing to add to what was presented in the staff report.

Motion was made by Kuritz/Dean to recommend approval of case SU-24-07.

The roll call vote was seven members for the motion to recommend approval, none opposed, and Member Turner was absent.

6. INFORMATION ITEM:

Secretary Dick invited members of the ZBA to attend the October 25, 2024, meeting of the Illinois Association of County Zoning Officials (IACZO). He distributed an agenda that included a link to the remote meeting.

7. ADJOURNMENT: The Chair declared the meeting adjourned at 7:48 PM.
