City of Fairbury City Council met May 1.

Here is the minutes provided by the council:

1. Call to order – Mayor Slagel called the meeting to order.

2. Mayor Slagel directed the Clerk to call roll and the following members of Council answered present: Gary Norris, Charles Hoselton, Jon Kinate, Bruce Weber, Gerald Hoffman, Lynn Dameron and Bill Schmidgall.

3. Pledge of Allegiance to the Flag

4. Motion to approve the Consent Agenda – Motion by Schmidgall, second by Kinate to approve the following items on the Consent Agenda:

A. Minutes from the April 17 , council meeting

B. Voucher Invoice Register listing the bills

C. Treasurer’s Cash Report (second meeting of the month)

D. Check Register (second meeting of the month)

E. None

F. Overtime Report

Motion carried 7-0. YES-Norris Hoselton Kinate Weber Hoffman Dameron Schmidgall

5. Mayor Slagel opened Public Comment and the following persons provided comments:

➢ Dave Shepard addressed the foul and offensive stench coming from his neighbor’s yard where the 2 dogs live without human occupants

6. Reports of Departments

→ Street Superintendent/Fire Chief Steidinger reported

• The roof at old city hall is leaking around the clock tower

→ Sewer Superintendent Duncan reported

• Rainfall over the last several days is totaled slightly over 5”; sewers are flowing

→ Water Superintendent Ifft – no report

→ Chief of Police Travis – no report

→ City Superintendent Ashburn reported

• He and Martin met with a representative from the Ottawa office of the Illinois Department of Transportation about making Locust Street ADA compliant. IDOT will engineer the northwest corner of 2nd and Locust Streets

→ City Attorney Mann introduced himself and thanked the Council for offering him the opportunity to serve our community

7. Reports of Aldermen

→ Alderman Norris reminded the public that pool passes are available at City Hall

→ Alderman Hoselton – no report

→ Alderman Kinate – no report

→ Alderman Weber – no report

→ Alderman Hoffman -no report

→ Alderman Dameron – no report

→ Alderman Schmidgall – no report

10. New Business – Discussion/Action Items

A. Attorney Mann administered the Oath of Office to recently elected aldermen Jon Kinate, Charles Hoselton, Steve Endres and Gary Norris

B. Motion by Norris, second by Hoffman to approve the Bank of Pontiac, Busey Bank, Morton Community Bank, First State Bank of Forrest and The Illinois Funds as the financial institutions for the City of Fairbury and to approve Dale Diller, Nancy Widlacki, Stephanie Meints and Brett Ashburn as check signers. Motion carried 8-0 YES-Norris Endres Hoselton Kinate Weber Hoffman Dameron Schmidgall

C. Motion by Kinate, second by Hoselton to approve Bank of Pontiac as the financial institution for the City of Fairbury Police Department restricted funds and unawarded seized funds accounts and to approve Randall Vedder and Dale Diller as check signers. Motion carried 8-0 YES-Norris Endres Hoselton Kinate Weber Hoffman Dameron Schmidgall

D. Motion by Dameron, second by Schmidgall to allow bills to be paid during the year to the Postmaster for postage, Dominy Library for memorials, Livingston County Clerk for recordings and health care payments specifically: health, dental, eye and third-party payer, along with Workman’s Comp, Commercial, and Professional Insurances. Also, gas credit card bills to avoid late charges if the bill arrives in between payment cycles/board meetings. Motion carried 8-0 YES-Norris Endres Hoselton Kinate Weber Hoffman Dameron Schmidgall

E. Consideration to approve City Overtime Policy - TABLED

F. Consideration to purchase two (2) new mixing tanks for water treatment plant from Merrick Industries in the amount of $14,865 - TABLED

G. Consideration of proposal from G.A. Rich to install mixing tanks and furnish/install related piping in the amount of $6,900 - TABLED

H. Consideration to hire for Street Department – TO BE CONSIDERED AFTER EXECUTIVE SESSION

I. Motion by Dameron, second by Hoffman to approve Ordinance No. 2019-6 Amending Parts Of Chapter 8 of the Municipal Code of the City of Fairbury of 1982 In Relation to Liquor and Tobacco. Motion carried 8-0 YES-Norris Endres Hoselton Kinate Weber Hoffman Dameron Schmidgall

J. Motion by Weber, second by Hoffman to approve a quote to purchase and install new motor for high pressure pump at water treatment plant from Armature Motor & Pump Company Inc. in the amount of $2,448.76. Motion carried 8-0 YES-Norris Endres Hoselton Kinate Weber Hoffman Dameron Schmidgall

K. Motion by Dameron, second by Norris to approve a request from Gig’s Place for alcohol in the street on May 25, 2019. Motion carried 7-1. YES-Norris Endres Kinate Weber Hoffman Dameron Schmidgall NO-Hoselton

L. Motion by Dameron, second by Schmidgall to approve a request from Chief Travis to purchase $100 worth of car wash tokens from All American Car Wash. Motion carried 8- 0 YES-Norris Endres Hoselton Kinate Weber Hoffman Dameron Schmidgall

11. Other Items for Discussion & Information

➢ Mayor Slagel shared a thank-you note from Prairie Central Principal Dan Groce for the donation of a family pool pass for the school’s carnival

12. Public Comment

NONE

13. Motion by Kinate at 7:13 p.m. to enter Executive Session, second by Schmidgall.

A. Personnel – Section 2(c)(1) – Employee hiring, firing, compensation, discipline and performance. (Note: An independent contractor is not an employee).

B. Litigation – Section 2(c)(11) – Pending, probable or imminent litigation. Probable or imminent litigation requires specific finding to that effect in closed session minutes.

Motion by Weber at 7:49 p.m. to enter Open Session, second by Hoselton.

Action from Executive Session –

10 H. Motion by Schmidgall, second by Dameron to allow Street Superintendent Martin Steidinger to offer employment to selected candidates. Motion carried 8-0 YESNorris Endres Hoselton Kinate Weber Hoffman Dameron Schmidgall

14. Adjournment – Motion by Kinate, second by Norris to adjourn @ 7:02 p.m.
