City of Pontiac Planning and Zoning Board Met Feb. 8.

The City of Pontiac Planning and Zoning Board held a meeting at 4:30 p.m. in the City Hall Council Chambers to consider the following:

Terra Manning, petitioner, has requested a Zoning Variance for Signage. Petitioner requests to exceed the square footage allowance of signage by 8 square feet. Section 103.444 of Table 7.06.3-Permitted Signs by Type and Zoning District states that signs attached to a building in a B-2 District must be 10% of the square footage of the wall. The South wall of the building is 240 square feet, allowing 24 square feet of Signage. The Owner of the building, David Gibson, has a sign placed on the building that is 16 square feet, allowing Petitioner to have 8 square feet for signage. Petitioner requests signage of 16 square feet, exceeding Code by 8 square feet. The legal description for the property is Northernly 7.5 feet and Southernly 100 feet on LOT 5 & ALL of LOT 6, Except Westernly 17.5 feet and Southernly 92.5 feet on Block 47 in the CITY OF PONTIAC subdivision, commonly known as 305 W. Washington Street, located in Livingston County in Pontiac, Illinois.

Donna Sartoris, petitioner, has requested a Zoning Variance for Signage. Petitioner requests to place a ground sign partially in the City Right of Way. Section 103.442(f) states that no sign shall project beyond the property line into the public Right of Way, and Section 103.442(g) states that a sign which displays a commercial message is permitted only on the premises where the business, professional, accommodation, commodity, service, entertainment, or other commercial activity represented on the sign is located. The legal description for the property is Lot 6 in First Addition to Fell’s Subdivision, commonly known as 519 W. Howard Street, located in Livingston County in Pontiac, Illinois.

The following members were present: Rick Baier, Paul Giordano, Tim Lewis, and Matt Stock. Bill Abraham, Pat Martin, and Bill Cole were absent.  Also present were David Wilson from the Building and Zoning office, City Administrator Bob Karls, City Engineer Brian Verdun, petitioners Terra Manning and Donna Sartoris, as well as two audience members. With a quorum being present, the meeting began at 4:29 p.m.

Tim Lewis made a motion to approve the minutes from the November 23, 2020 meetings and with a second from Rick Baier and a unanimous yes vote, the minutes were approved. Terra Manning stood before the Board stating that she currently shares a building with building owner, David Gibson, with whom already has a sign in place. Ms. Manning stated that she requests a sign matching the same size as the signage already in place and that Mr. Gibson does not wish to make his sign smaller. With no comments from the Board and with no objections, Rick Baier made a motion to recommend approval of variance. With a second from Tim Lewis and a unanimous yes vote, the motion was approved.

Donna Sartoris stood before the Board requesting a sign partially in the City Right of Way. Mrs. Sartoris made a statement that a sign has been in this spot previously and that the sign would follow all City guidelines. Tim Lewis mentioned that approval should be made since approval was made in the past. David Wilson mentioned that if Mrs. Sartoris posted a sign strictly on her property, the sign would be up to her sidewalk and would not be able to be seen from the public. With no further comments, Tim Lewis made a motion to approve the variance and with a second from Matt Stock and a unanimous yes vote, the motion was approved. Mr. Karls mentioned that a License Agreement and Insurance would need to be in place.

Mr. Karls mentioned to the Board that Vermillion Plaza is being considered for Indoor Climate Controlled Storage Facility. Section 108-32(k) states that Self-service storage facilities, as defined in 770 ILCS 95/2(A), shall satisfy all of the following site characteristics and development requirements:1.The affected property is adjacent to a railroad right-of-way, or former railroad right-of-way, or separated therefrom only by a public street or road right-of-way, or the affected property is adjacent to property having an M-1 Limited Manufacturing District zoning classification, or separated therefrom only by a public street or road right-of-way.2.All individual storage units in the proposed facility are 200 square feet or less.3.All vehicle approaches, drives, parking areas, and other developed areas upon which vehicle traffic is contemplated shall be surfaced as required for parking facilities under the terms of article VI of this chapter. Mr. Karls opened discussion to the Board about a possibility of amending the Code for the Indoor Storage Facility. Mr. Baier stated that the outside parking lot must remain open and Mr. Stock stated that conditions should be kept and a Special Use must be placed to open the facility. Mr. Karls stated that the discussion will be taken to City Council.

With no further discussion, Paul Giordano made a motion to adjourn the meeting and with a unanimous yes vote from the Board, the meeting was adjourned at 4:40 p.m.
