City of Fairbury City Council met Sept. 21

City of Fairbury City Council met Sept. 21.

Here are the minutes provided by the council:

1. Call to order – Mayor Slagel called the meeting to order at 6:30 p.m.

2. Mayor Slagel directed the Clerk to call roll and the following members of Council answered present: Gary Norris, Steve Endres, Jon Kinate, Bruce Weber, Gerald Hoffman, James Tipton and Bill Schmidgall. Charles Hoselton was absent.

3. Pledge of Allegiance 

4. Motion to approve the Consent Agenda – Motion by Hoffman, second by Tipton to approve the following items on the Consent Agenda:

A. Minutes from the September 7, 2022, council meeting

B. Voucher Invoice Register listing the bills

C. Treasurer’s Cash Report (second meeting of the month)

D. Check Register (second meeting of the month)

E. NONE

F. Overtime Report

Motion carried 7-0. YES-Norris Endres Kinate Weber Hoffman Tipton Schmidgall

5. Mayor Slagel opened Public Comment and the following persons provided comments: 

⮚ Chief of Police McCormick swore in Officers Jason Keeling, Carter Meister and Alex Lorsbach 

⮚ Pam Price asked if ATVs are allowed on city streets 

6. Reports of Departments 

→ Streets & Fire – Martin Steidinger, Superintendent & Fire Chief – no report 

→ Sewer – Brad Duncan, Superintendent reported

• The new GIS system is up and running and it’s going well

→ Water – Mike Mellott, Superintendent was absent

→ Police – Robert McCormick, Chief reported

• His department completed their training with SELCAS

→ City – Brett Ashburn, Superintendent reported

• We received the 35-gallon trash carts and after tonight they will be ready to be distributed to those who request one

→ Legal – Steven Mann, City Attorney – no report

7. Reports of Aldermen 

→ Alderman Norris – no report

→ Alderman Endres said he believed a constituent, Pam Price, wanted to address some issues she’s having. No report otherwise. (See Public Comment section above) 

→ Alderman Hoselton was absent

→ Alderman Kinate reported the banner on 7th Street has been taken down; the mattresses have been moved

→ Alderman Weber – no report

→ Alderman Hoffman – no report

→ Alderman Tipton – no report

→ Alderman Schmidgall reported the new sensors on the stop lights are working well

10. New Business – Discussion/Action Items 

A. Motion by Schmidgall, second by Hoffman to approve the 2021-2022 Audit as presented by MCK CPAs & Advisors. Motion carried 7-0. YES-Norris Endres Kinate Weber Hoffman Tipton Schmidgall

B. Motion by Kinate, second by Hoffman to approve a request from Santos Mendoza, owner of George’s Dawghouse, LLC, to operate his hot dog cart on a city street (122 W Locust St) Saturday, October 8th from 10 a.m. to 3 p.m. with service hours of 11 a.m. to 2 p.m. Motion carried 7-0. YES-Norris Endres Kinate Weber Hoffman Tipton Schmidgall

C. Motion by Endres, second by Norris to approve the administration of payments of Police invoices involving vehicle repairs/replacements from the general fund. Motion carried 7- 0. YES-Norris Endres Kinate Weber Hoffman Tipton Schmidgall

D. Motion by Kinate, second by Weber to approve the purchase of a 2023 Dodge Durango in the amount of $46,110 to replace the Police Department’s 2016 Ford Explorer. Motion carried 7-0. YES-Norris Endres Kinate Weber Hoffman Tipton Schmidgall

E. Motion by Kinate, second by Hoffman to approve Ordinance No. 2022-13 amending Chapter 6, Refuse and Garbage, Section .04 of the Municipal Code Book. Motion carried 7-0. YES-Norris Endres Kinate Weber Hoffman Tipton Schmidgall

F. Motion by Endres, second by Norris to approve the purchase of a used dump truck for the Street Department for an amount not to exceed $20,000. Motion carried 7-0. YES Norris Endres Kinate Weber Hoffman Tipton Schmidgall

12. Public Comment  

⮚ Pam Price asked for clarification on who responds to Municipal Code violations and Zoning Code violations 

13. Motion by Schmidgall, second by Kinate to enter Executive Session at 7:10 p.m. 

A. Personnel – Section 2(c)(1) – Employee hiring, firing, compensation, discipline and performance. (Note: An independent contractor is not an employee). 

Motion by Kinate, second by Tipton to enter Open Session at 7:19 p.m.

14. Adjournment – Motion by Schmidgall, second by Kinate to adjourn at 7:19 p.m. Nancy Widlacki, City Clerk
