City of Pontiac City Council met Dec. 2.

Here is the minutes provided by the council:

The regular meeting of the Pontiac City Council was held on Monday, December 2, 2019 in the City Hall Council Chambers.

Acting Mayor Alvey called to order the meeting of the City Council at 7:00 P.M.

The City Clerk was directed to call roll, and the following members of the Council were present: Alvey, Swanson, Kallas, Eckhoff, Hicks, Causer, Bradshaw, Myers, Gabor and Wille.

MEETING OF THE PONTIAC CIVIC CENTER AUTHORITY

Acting Mayor Alvey asked that the record show the same Aldermen present for this meeting as are present for the regular Council meeting: Alvey, Swanson, Kallas, Eckhoff, Hicks, Causer, Bradshaw, Myers, Gabor, and Wille.

Acting Mayor Alvey asked if there was any business to come before the Civic Center Board this evening. Hearing none, he declared the meeting closed.

CONSENT AGENDA

Acting Mayor Alvey stated that there were five items on the consent agenda. He asked if there was a need to have any item removed for later discussion. Hearing none, motion made by Gabor, second by Myers, that the items on the consent agenda be approved as presented.

A. Motion by Gabor, second by Myers, to approve the minutes of the November 18, 2019 City Council Meeting. On a roll call vote, motion carried 10-0. Aye votes recorded: Alvey, Swanson, Kallas, Eckhoff, Hicks, Causer, Bradshaw, Myers, Gabor and Wille.

B. Motion by Gabor, second by Myers, to approve payment of bills totaling $275.41 from the TIF I Fund. On a roll call vote, motion carried 10-0. Aye votes recorded: Alvey, Swanson, Kallas, Eckhoff, Hicks, Causer, Bradshaw, Myers, Gabor and Wille.

C Motion by Gabor, second by Myers, to approve the payment of bills totaling $275,442.26 from all other funds. On a roll call vote, motion carried 10-0. Aye votes recorded: Alvey, Swanson, Kallas, Eckhoff, Hicks, Causer, Bradshaw, Myers, Gabor and Wille.

D. Motion by Gabor, second by Myers to approve the referral of a petition for a PUD filed by Andy & Shirley Eckel to Pontiac Planning Commission. On a roll call vote, motion carried 10-0. Aye votes recorded: Alvey, Swanson, Kallas, Eckhoff, Hicks, Causer, Bradshaw, Myers, Gabor and Wille.

E. Motion by Gabor, second by Myers to approve the meeting schedule for the Pontiac City Council and various Boards and Commissions. On a roll call vote, motion carried 10-0. Aye votes recorded: Alvey, Swanson, Kallas, Eckhoff, Hicks, Causer, Bradshaw, Myers, Gabor and Wille.

REGULAR AGENDA

A. Ordinance 2019-O-027 - Annexation and Zoning Ordinance

Motion by Eckhoff, second by Hicks to approve Ordinance 2019-O-027, an ordinance annexing and zoning listed properties to the City as written. On a roll call vote, motion carried 10-0. Aye votes recorded: Alvey, Swanson, Kallas, Eckhoff, Hicks, Causer, Bradshaw, Myers, Gabor and Wille.

B. Ordinance 2019-O-025 - Zoning Amendments pertaining to Adult Use of Cannabis

Discussion on the proposed ordinance. City Attorney noted he followed the Municipal League model ordinance. The ordinance explains definitions and zoning qualification, distances to schools, etc. Motion by Gabor, second by Bradshaw to approve Ordinance 2019-O-025, and ordinance amending zoning for adult use cannabis. On a roll call vote, motion carried 8-2. Aye votes recorded: Alvey, Swanson, Kallas, Eckhoff, Hicks, Causer, Bradshaw and Gabor. Nay votes recorded: Myers and Wille.

C. Ordinance 2019-O- 026 - Imposing a Municipal Cannabis Retailers Tax

Motion by Hicks, second by Swanson to approve Ordinance 2019-O-026, an ordinance imposing a Municipal Cannabis Retailers’ Occupation Tax of 3%, as written. On a roll call vote, motion carried 9-1. Aye votes recorded: Alvey, Swanson, Kallas, Eckhoff, Hicks, Causer, Bradshaw, Gabor and Wille. Nay vote recorded: Myers

D. Ordinance 201o-O-028 - Levy Ordinance

Continued discussion on the proposed Levy Ordinance. The City is waiting on one more data item and then the ordinance will come before the next City Council meeting for vote.

Mayor Comments

Acting Mayor Alvey reminded Council of the Business After Hours honoring City employees and elected officials on December 12th and the City tree lighting on December 6th.

Administrator Comments

Taylor Baxter announced that Marlon Eilts has planned a family celebration and will be working with the City on a “Last Night” party on December 31st from 6:00 PM to 9:00 Pm at the Rec Center.

Council Comments

Alderwoman Eckhoff asked about leaf pick up. Chris Brock said it will be continued thru the 2nd week in December.

Public

Brian Schulter asked about the status of roads being fixed in Pontiac, especially the corner near where he lives at Lyons Street and Water Street. Bob Karls explained the process of roads getting fixed and the cost. He also brought up that their will be a referendum on the next election to increase the sales tax, which if passed will help with the cost of repairing streets.

Executive Session

Motion by Wille, second by Bradshaw to adjourn to Executive Session for the purpose of discussing property acquisition and property disposition matters as authorized under Section 2(c)2 of the Illinois Open Meeting Act. On a roll call vote, motion carried 10-0. Aye votes recorded: Alvey, Swanson, Kallas, Eckhoff, Hicks, Causer, Bradshaw, Myers, Gabor and Wille

Adjournment

On motion duly made and seconded, the regular meeting of the City Council was adjourned.
