City of Pontiac Planning and Zoning Board met Dec. 13.

The City of Pontiac Planning and Zoning Board held a meeting at 4:30 p.m. in the City Hall Council Chambers to consider the following:
Timothy and Patricia Fogarty, petitioners, have requested that a portion of West Washington Avenue and West Lincoln Avenue be vacated and ownership of same be deeded over to the Petitioners and/or adjoining landowner, the City of Pontiac, IL. The properties in question are:
TRACT 1:
Lots 1 and 2 in Block 1 in Haynes and John’s Addition to Pontiac, Livingston County, Illinois, EXCEPT a strip of land :beginning at the Northwest Corner of said Lot 2, thence East 113.66 feet along the North lines of said Lots 2 and 1, thence Southeasterly along a curve of radius 474.36 feet (said curve being concave to the Northwest) to a point on the West line of said Lot 2, said point being 39.9 feet North of the Southwest Corner thereof, thence North to the Point of Beginning, all contained in Lots 1 and 2 in Block 1 in Haynes and John’s Addition to the City of Pontiac, Livingston County, Illinois. The Permanent Real Estate Tax Index Number is 15-15-22-201-004.
TRACT 2:
Lots 1, 2, 3, and 4 in Block 6 in Haynes and John’s Addition to Pontiac, Livingston County, Illinois. The Permanent Real Estate Tax Index Number is 15-15-22-203-009.
TRACT 3:
Lots 7, 8, 9, 10, and 11 in Block 6 in Haynes and John’s Addition to Pontiac, Livingston County, Illinois. The Permanent Real Estate Tax Index Numbers are 15-15-22-203-004, 15-15-22-203-005, 15-15-22-203- 006, and 15-15-22-203-007.
TRACT 4:
Lots 5 and 6 in Haynes and John’s Addition to the City of Pontiac, in Livingston County, Illinois. The Permanent Real Estate Tax Index Number is 15-15-22-203-008.
TRACT 5:
The North 40 feet of Lots 1, 2, and 3 all in Block 9 in Haynes and John’s Addition to Pontiac, Livingston County, Illinois. The Permanent Real Estate Tax Index Number is 15-15-22-207-003.
The following members were present: Bill Cole, Paul Giordano, Matt Stock, and Bill Abraham. Pat Martin, Tim Lewis, and Rick Baier were absent. Also present were David Wilson, Building & Zoning Officer, Alan Schrock, City Attorney, Brian Verdun, City Engineer, Bob Karls, City Administrator, Don Hicks, Patricia and Tim Fogarty, and Brian Gabor, attorney for Petitioner. With a quorum being present, the meeting began at 4:33 p.m.
Bill Abraham made a motion to approve the minutes from the November 22nd, 2021 meeting, and with a second from Bill Cole and with a unanimous yes vote, the minutes were approved.
Mr. Gabor stood before the Board and stated that Petitioners have operated their business on this property for over 30 years and their tax bill indicates that said portion is already vacated, meaning Petitioners have been paying taxes on this portion. Livingston County Assessors Office noticed the error and pointed the error out to the Building and Zoning office, stating there are no records indicating a vacation. After brief discussion, Bill Abraham made a motion to recommend approval for a vacation of a portion of West Washington Street and West Lincoln Avenue, and with a second from Matt Stock and a unanimous yes vote, the motion was approved.
With no further business, Matt Stock made a motion to adjourn the meeting and with a unanimous yes vote, the meeting was adjourned at 4:46 p.m.
