McLean County Zoning Board of Appeals met Nov. 1.

Here are the minutes provided by the board:

1. CALL TO ORDER: Chair, James Finnigan called the meeting to order at 7:00 PM.

2. ROLL CALL: Secretary Philip Dick called the roll and noted the presence of a quorum as follows: James Finnigan, Ruth Novosad, Brian Bangert, Michael Kuritz and Julia Turner. Rick Dean was absent. Also present were Darrell Mitchell, Zoning Enforcement Officer, and Taylor Williams, Assistant State’s Attorney.

3. APPROVAL OF MINUTES: Motion was made by Kuritz/Turner to approve the minutes from the October 4, 2022, Zoning Board of Appeals meeting.

The minutes were approved by voice vote.

4. APPEARANCE BY MEMBERS OF THE PUBLIC: No one came forward to speak on matters not on the agenda.

5. REGULAR AGENDA:

Case ZV-22-13, an application of Mike Strubhar in case ZV-22-13 on parcel 26-15-100-002. He is requesting a variance in side yard requirements to allow an existing barn to be as close as 2.8 feet from the property line rather than 20 feet as required in the A-Agriculture District on property in Mount Hope Township at 3683 E 600 North Rd., McLean, IL.

Secretary Dick called the case, provided exhibits to the board, and submitted a staff report for review. He indicated that staff recommends that the proposed application meets all of the standards of the Zoning Ordinance for variances.

Mike Strubhar, 4340 E 600 North Rd., McLean, IL, appeared to give testimony and was sworn. Mr. Strubhar indicated that this is the home that he grew up in and that the family now wants to turn it over to someone else.

The board reviewed and discussed the proposed variance.

Motion was made by Bangert/Kuritz to approve case ZV-22-13.

The roll call vote was five members for the motion to approve, none opposed, and Member Rick Dean was absent.

Case ZA-22-07, an application of Evergreen FS in case ZA-22-07 on parcel 20-35-402-019. It is requesting a map amendment to change the zoning classification from A-Agriculture District in part and M-1 Restricted Manufacturing District in part to the M-2 General Manufacturing District on property in Dale Township at 10769 Quinn St., Shirley, IL.

Justin Otto, Evergreen FS Operations Manager, 402 N. Hershey Rd., Bloomington, IL and John Tuttle, Evergreen FS CEO, 402 N. Hershey Rd., Bloomington, IL, appeared to give testimony and were sworn.

Mr. Otto indicated that they want to replace the Evergreen FS dry fertilizer capacity at their Danvers facility and their McLean facility to the Shirley facility.

Kristian Kremer, 8404 Shirlane St., Shirley, IL asked if he would have a say about the proposed building. He asked what screen would be installed and where it would be located.

Secretary Dick indicated that Mr. Kremer would have a say about the building in the variance case that was next on the agenda. Secretary Dick explained where the screen and buffer would be located.

Kristian Kremer, 8404 Shirlane St., Shirley, IL, appeared to give testimony and was sworn. Mr. Kremer indicated that he is concerned about the additional noise and smell of the expansion toward his property. He suggested that the expansion of the facility should be toward the south.

The board reviewed and discussed the standards for a zoning map amendment. Motion was made by Turner/Kuritz to recommend approval of case ZA-22-07.

The roll call vote was five members for the motion to recommend approval, none opposed, and Member Rick Dean was absent.

Case ZV-22-14, an application of Evergreen FS in case ZV-22-14 on parcel 20-35-402-019. It is requesting a variance in maximum height regulations to be 50.5 feet in height rather than 35 feet as allowed in the M-2 General Manufacturing District for a fertilizer storage building on property in Dale Township at 10769 Quinn St., Shirley, IL.

Secretary Dick called the case, provided exhibits to the board, and submitted a staff report for review. He indicated that staff recommends that the proposed application meets all of the standards of the Zoning Ordinance for variances.

Justin Otto, Evergreen FS Operations Manager, 402 N. Hershey Rd., Bloomington, IL and John Tuttle, Evergreen FS CEO, 402 N. Hershey Rd., Bloomington, IL, appeared to give testimony and remained sworn from the previous case.

Mr. Tuttle indicated that Evergreen FS covers five counties and plans to be a good neighbor. He indicated that the proposed structure would store granular fertilizer and that the odor would be self-contained in the building.

Mr. Otto indicated that a fertilizer building would not fit on the site without a variance.

Jim Soeldner, 201 S. Main St., Ellsworth, IL, asked if dust will be created from dumping the fertilizer.

Mr. Otto indicated that the unloading of fertilizer at the plant would not create dust.

Secretary Dick asked if they would provide a screen and buffer along R-1 zoned lots and asked how the dust would be controlled from the trucks driving on the property.

Mr. Otto indicated that they would provide a screen and buffer and would have a water truck on the property to keep dust down.

The board reviewed and discussed the proposed variance.

Motion was made by Turner/Bangert to approve case ZV-22-14 with the following two stipulations: 1) that dust would be controlled; and 2) that a planting screen would be planted in the buffer as tall as possible as coordinated between the NRCS and the Director of Building and Zoning.

The roll call vote was three members for the motion to approve – Members Finnigan, Bangert and Kuritz, two members were opposed – Members Turner and Novosad, and Member Rick Dean was absent.

Case ZV-22-15, an application of Kyle Tague for the Green Gables Bar & Grill, in case ZV-22- 15 on parcel 07-12-126-001. He is requesting a variance in front yard and paving requirements to allow a restaurant to be as close as 21 feet from the property line rather than 40 feet as required and to allow 21 paved parking spaces and 13 unpaved parking spaces rather than 34 paved parking spaces as required in the C-Commercial District on property in Hudson Township at 17485 E 2500 North Rd., Hudson, IL.

Secretary Dick called the case, provided exhibits to the board, and submitted a staff report for review. He indicated that staff recommends that the proposed application meets all of the standards of the Zoning Ordinance for variances.

Kyle Tague, 25424 N 1750 East Rd., Hudson, IL, and Amy Tague, 25424 N 1750 East Rd., Hudson, IL appeared to give testimony and were sworn. Mr. Tague indicated that the Green Gables Bar and Grill burned down on May 9, 2022, and that the seating capacity of the proposed new bar and grill would be expanded. He indicated that he is required by the Health Department to expand the septic field by 800 square feet for the proposed building.

Mrs. Tague indicated that they plan to keep the iconic front porch.

The board reviewed and discussed the proposed variance.

Motion was made by Kuritz/Novosad to approve case ZV-22-15.

The roll call vote was five members for the motion to approve, none opposed, and Member Rick Dean was absent.

6. ADJOURNMENT: The Chair declared the meeting adjourned at 9:12 PM.
