The City of Pontiac Planning and Zoning Board held a meeting on Monday, December 12, 2022 at 4:30 p.m. in the City Hall Council Chambers to consider the following:
William Eaton III, petitioner, is requesting an After the Fact Variance as well as a Zoning Variance to allow crushed asphalt over gravel base for a parking area an RV that the petitioner constructed of crushed asphalt over a gravel base without a permit. Petitioner wants to retain the current construction and not provide an all weather dustless surface as required by code. 103-477(i)(2) states that all open off-street parking areas and driveways shall be improved with a compacted macadam base, not less than four inches thick, surfaced with asphaltic concrete or some comparable all weather dustless material. Petitioner added said driveway to lot without mandatory permits, breaking code 103-277(c), which states that no permit as required by city building regulations shall be issued by the building inspector for the construction of a building, structure, or land improvement, […] until the building inspector certifies that the application for a permit, including accompanying plans and specifications. *Please note- an error regarding Section 103-505(a) was quoted on the Public Notice, however, this particular code has not been broken by petitioner. The following members were present: Bill Abraham, Tim Fogarty, Paul Giordano, Tim Lewis, Matt Stock, and Rick Baier. Pat Martin was absent. Also present were David Wilson from the Building and Zoning Office, City Administrator, Jim Woolford, petitioner William Eaton III, Mary Lou Legner, and Sue Smith were all in attendance.
Tim Lewis made a motion to approve the minutes from the November 28, 2022 meeting, and with a second from Bill Abraham and a unanimous yes vote, the minutes were approved. Mr. Eaton III stated that he was unaware that he needed a permit or any driveway requirements. David Wilson, Building and Zoning, mentioned to the Board that petitioner made a mistake by
not getting a permit, but is trying to correct his mistake. With no discussion from the Board, Rick Baier made a motion to approve the variance, and with a second from Bill Abraham and a unanimous vote, the motion passed.
Sue Smith and Mary Lou Legner attended the meeting in hopes of reviewing the new ordinance regarding chicken ownership, however Jim Woolford mentioned that Alan Schrock, City Attorney, is still in the process of drafting said ordinance, and that once ordinance is drafted, it will go to City Council before Planning Commission, expected to be another few weeks.
With no further discussion, Matt Stock made a motion to adjourn the meeting and with a unanimous vote, the meeting was adjourned at 4:41 p.m.
