The City of Pontiac Planning and Zoning Board held a hearing on Monday, December 10, 2018 at 4:30 p.m. in the City Hall Council Chambers to consider the following:
City of Pontiac, petitioner, requests that property recently annexed into the City limits with a zoning classification of R-1 (Single Family Residential) be re-zoned to an A-1 (Agricultural District) zoning classification. The legal description of the property is as follows: TRACT A: The portion of the following described tract of real estate situated in Esmen Township, Livingston County, Illinois: That part of the East Half of the Northeast Quarter of Section 2, together with that part of the Northwest Quarter of Section 1, all in Township 28 North, Range 5 East of the Third Principal Meridian, also together with that part of the South Half of the Southeast Quarter of Section 35 and that part of the South Half of the Southwest Quarter of Section 36, all in Township 29 North Range 5 East of the Third Principal Meridian, all situated in Livingston County, Illinois bounded and described as follows: Beginning at the Northwest Corner of said East Half of the Northeast Quarter of Section 2, and running thence South 88 degrees 47 minutes 22 seconds West along the North line of said Section 2 being also the South line of said Section 35, 716.14 feet to a point on the Southerly right of way line of F.A.I. Route 55, thence North 31 degrees 20 minutes 07 seconds West along said Southerly line 20.23 feet; thence North 58 degrees 39 minutes 53 seconds East along said Southerly line 2582.68 feet to a point on the North line of said South Half of the Southwest Quarter of Section 36, which point is 191.22 feet East from the Northwest Corner of said South Half of the Southwest Quarter; thence North 89 degrees 14 minutes 55 seconds East along said North line of said South Half 251.14 feet to the center of a public road; thence South 11 degrees 08 minutes 57 seconds West along said center 88.22 feet; thence South 11 degrees 50 minutes 10 seconds West along said center 703.61 feet; thence South 12 degrees 01 minutes 03 seconds West along said center 556.22 feet to a point on the North line of said Northwest Quarter of Section 1, which point is 137.73 feet East from the Northwest Corner of said Section 1; thence South 11 degrees 48 minutes 55 seconds West along said center of public road 532.69 feet; and thence South 58 degrees 39 minutes 07 seconds West 1558.12 to the West line of said East Half of the Northeast Quarter; and thence North 00 degrees 36 minutes 04 seconds West along said West line 1302.74 feet to the point of beginning, containing 65.85 acres or land, more or less. Part of PIN # 09-09-35-400-003 and all of PIN #09-09-35- 400-004. The property is located South of I-55 and North of East 2100 North Road, Pontiac, Illinois.
The following members were present: Bill Abraham, Rick Baier, Paul Giordano, Tim Lewis, Pat Martin and Matt Stock. Bill Cole was absent. Also present were Dave Lopeman from the Building office, City Administrator Bob Karls and Don Mackinson. With a quorum being present, the meeting began at 4:30 p.m.
Tim Lewis made a motion to approve the minutes from the November 29, 2018 meeting and with a second by Pat Martin and a unanimous yes vote, the minutes were approved. City Administrator Bob Karls told the Board that this meeting was to re-zone property that was recently annexed into the City, but due to a notification issue, was assigned the least restrictive zoning classification of R-1 (Single Family Residential). The City’s petition is to change the R-1 to A-1 (Agricultural). Mr. Don Mackinson asked why the property was zoned R-1 and it was explained to him that property must come in with the most restrictive zoning, if no zoning has been specified. Mr. Mackinson also asked if this parcel would have solar panels on it and Mr. Karls said no. Tim Lewis made a motion to recommend to the City Council to approve the zoning of A-1. Matt Stock seconded the motion and the motion passed with 6 yes votes.
Bill Abraham made a motion to adjourn the meeting and with a second by Pat Martin and a unanimous yes vote, the meeting adjourned at 4:45 p.m.
