4. COMPLAINT AND CITATION:

A. 35 YEARS, LLC LANDMARK, d/b/a Marie’s Place, 1520 E. College Avenue, Normal, IL:

On February 20, 2019, 35 Years, LLC Landmark, d/b/a Marie’s Place, 1520 E. College Avenue, was subject to a Gaming Parlor Audit conducted by the Normal Police Department. That investigation indicated the establishment did not serve food or have adequate food available for sale.

The establishment’s 2019-20 Class O license renewal application came before the Liquor Commission on March 18, 2019 and on that date, the Commission elected to take no action on the renewal application and instead allow a public hearing to be conducted in front of an Administrative Hearing Officer.

That Officer was to make a recommendation to the Liquor Commission prior to final action on the license renewal.

An initial hearing was convened last year and later suspended while jurisdictional issues were argued, and a sale of the business was pursued.

Following a February 19, 2020 Gaming Parlor Audit, the licensee’s establishment was again found to be out of compliance with the requirements of the liquor license.

A hearing was again convened on March 9, 2020. Following argument regarding jurisdictional issues, the hearing officer continued the hearing to March 19, 2020.

It is expected that the hearing officer will make a final determination at that hearing and forward his recommendation to the Liquor Commission for final action thereafter.

B. 35 YEARS, LLC PATRIOT CENTER, d/b/a Marie’s Place, 115 Susan Drive, Suite H, Normal, IL:

On February 20, 2019, 35 Years, LLC Patriot Center, d/b/a Marie’s Place, 115 Susan Drive, was subject to a Gaming Parlor Audit conducted by the Normal Police Department. That investigation indicated the establishment did not serve food or have adequate food available for sale.

C. 35 YEARS, LLC UNIVERSITY PARK, d/b/a Marie’s Place, 1702 W. College Avenue, Normal, IL:

35 Years, LLC University Park, d/b/a Marie’s Place, 1702 W. College Avenue, failed to provide a bond and proof of dram shop insurance as required with its 2019-20 Class O liquor license renewal application.

D. CASE 2020-LC-1: FREEDOM OIL COMPANY., d/b/a Freedom Oil Company, 1617 N. Main Street, Normal, IL:

On February 13, 2020, Freedom Oil Company, d/b/a Freedom Oil Company, 1617 N. Main Street, furnished alcohol to a person under 21 years of age. A Stipulation, Guilty Plea and Settlement Agreement was proposed on February 21, 2020, for a fine in the amount of $5000.00, as this was the second offense for this establishment. Commissioner Koos entered an Order on February 26, 2020, for a fine in the amount of $500.00, which has been paid by the establishment.

5. LIQUOR LICENSE APPLICATION: JDHQ HOTELS LLC., d/b/a Bloomington- Normal Marriott, 201 Broadway Avenue, Normal, IL:

We have received the completed application from JDHQ HOTELS LLC., d/b/a Bloomington-Normal Marriott, for a Class E (Hotels) at 201 Broadway Avenue, along with related documents. This application is for the purpose of a change in ownership.

RECOMMENDATION: The Commission recommends approval of a Class E and an Entertainment Permit to JDHQ HOTELS LLC., d/b/a Bloomington-Normal Marriott, at 201 Broadway Avenue, Normal, Illinois, with no stipulations.

6. OMNIBUS VOTE AGENDA:

(All items under the Omnibus Vote Agenda are considered to be routine in nature and will be enacted by one motion. There will be no separate discussion on these items unless a Commission member so requests; should this occur, the item will be removed from the Omnibus Vote Agenda and considered as the first item after approval of the Omnibus Vote Agenda.)

The following businesses have met all requirements for renewal of their respective liquor licenses. The requirements for renewal which have been complied with are Renewal Application, Resident Agent/Manager Statement, Fire Inspection, Health Inspection, Security Statement, Clear City Debt Check, Entertainment Permit (where required) and Fee paid.
