Mclean County Zoning Board of Appeals met June 2.

Here is the minutes provided by the board:

1. CALL TO ORDER: Chair, James Finnigan called the meeting to order at 7:00 PM.

2. ROLL CALL: Secretary Philip Dick called the roll and noted the presence of a quorum as follows: James Finnigan, Rick Dean, Mary Beth Taylor, Michael Kuritz and Drake Zimmerman. Member Brian Bangert arrived at 7:07 PM. Member Julia Turner was absent. Also present were Darrell Mitchell, Zoning Enforcement Officer, Craig Nelson, County IT Director, Samantha Vasquez, Assistant State’s Attorney and Jessica Woods, Assistant State’s Attorney.

3. APPROVAL OF MINUTES: Motion was made by Dean/Kuritz to approve the minutes from the May 5, 2020 Zoning Board of Appeals meeting.

The roll call vote was five members for the motion to approve, none opposed, and Members Brian Bangert and Julia Turner were absent.

4. APPEARANCE BY MEMBERS OF THE PUBLIC: Secretary Dick announced that the public could call the following number Toll Free to listen to the public hearing in real time, and at the appropriate time ask questions or give testimony: 1 877 309 2073, Access Code: 536-659-109. No one notified the Department of Building and Zoning by May 29, 2020 that they wanted to speak or submit a written communication on matters on or not on the agenda.

5. REGULAR AGENDA:

Case SU-20-03, application of Lake Bloomington Marine, LLC by Erik Pokarney in case SU-20-03 on parcel 08-05-300-008. This is a request to allow a Boat Sales & Service Facility in the Agriculture District on property in Money Creek Township at 25182 N 1925 East Rd., Lexington, IL.

Secretary Dick called the case, provided exhibits to the board and submitted a staff report for review. He indicated the seven standards for a special use are met.

Erik Pokarney, 24441 Anderson Dr., Hudson, IL, appeared to give testimony and was sworn. Mr. Pokarney indicated that he learned a lot about the zoning process with this case and the case he submitted earlier. He said that he wanted to thank B&Z staff, Health Department and Highway Department staff and County Board members for their help.

The board reviewed and discussed the seven standards and found them met. Motion was made by Kuritz/Bangert to recommend approval of case SU-20-03.

The roll call vote was six members for the motion to recommend approval, none opposed and Member Turner was absent.

Case SU-20-05, application of Wilbur Ludwig in case SU-20-05 on parcel 15-32-451- 006. This is a request to amend special use case SU-87-09 for a Planned Unit Development for the Prairie Commercial Park to add an Outdoor Recreation Tennis Court in the M-1 Restricted Manufacturing District on property in Towanda Township at 14051 Prairie Commercial Park, Bloomington, IL.

Secretary Dick called the case, provided exhibits to the board and submitted a staff report for review. He indicated the seven standards for a special use are met, provided lighting for the proposed tennis court is shielded, to direct lighting to the subject property.

Wilbur Ludwig, 1526 Beckenham Dr., Bloomington, IL, appeared to give testimony and was sworn. Mr. Ludwig said thanks for everyone’s help. He said that the tennis court will be an asset to the property and that he would not have lights for the tennis court to begin with.

The board reviewed and discussed the seven standards and found them met, provided lighting for the proposed tennis court is shielded, to direct lighting to the subject property.

Motion was made by Kuritz/Taylor to recommend approval of case SU-20-05, provided lighting for the proposed tennis court is shielded, to direct lighting to the subject property.

The roll call vote was six members for the motion to recommend approval, none opposed and Member Turner was absent.

6. DISCUSSION OF FUTURE MEETING DATES:

Secretary Dick indicated that the ZBA will next meet on Tuesday, July 7 and then on Monday, July 20 at 7:00 PM. He said that Chairman Finnigan and the applicant for Geronimo Energy agreed to the July 20th meeting date. Secretary Dick indicated that meetings on the 3rd Tuesday of the month are not feasible since the County Board now meets at that time. He said that the ZBA may need to meet the 3rd Monday in August and the 3rd Monday in September. All members indicated that they would be available to attend a ZBA meeting on July 20th at 7:00 PM.

7. ADJOURNMENT:

The Chair declared the meeting adjourned at 7:45 PM.
